INDIAN RAILWAY ACT, 1989
Some of the important provisions relating to rail
passengers as envisaged in the Railway Act 1989 which came in to force
from 1 st July 1990 are indicated below for information of the rail
passenger.
1. Ticket less travel
: When a
passenger is found a traveling without a pass or ticket, he will be charged with
a single journey fare for the distance he traveled plus Rs. 50/- or equivalent amount of fare
whichever is more (Sec. 138)
2. Fraudulent Traveling : In case a
person travels without a ticket and with intent defraud the Railway he shall also be liable to
a fine upto Rs. 1000 and /or imprisonment upto 6 months. (Sec.137)
3. Transfer or Sale of Ticket:
Incase of
Transfer /Sale Railway Ticket unauthorizedly the penalty may extend
upto Rs. 500/-. and /or imprisonment upto 3 months. (Sec.142)
4. Alarm Chain : Incase of misuse of Alarm
Chain a find of Rs. 1000/- and /or imprisonment upto one year may be imposed.
1. Entering carriage Reserved for females
: If a male person enters a carriage reserved for
females or having entered such carriage remains therein, he
is liable for fine upto Rs.500/- apart from forfeiture of
his pass or ticket (Sec.162)
2. Unlawful carrying Reserved for Females:
If a person takes with him any dangerous goods in
contravention of Sec.67 , he shall be punishable
imprisonment upto three year and /or fine upto Rs.1000/- and
shall also be liable for loss or damage with may be caused
by reason of bringing such goods on railway (Sec.164)
3. Drunkenness or Nuisance : If a
person in a Railway carriage
(i) is in a state of
intoxication.
(ii) Commits any nuisance
He may be removed from the railway carriage
and shall also be liable for
imprisonment up to six month and fine upto Rs.
500/-(Sec.145)
4. Travelling on Roof /Steps of carriage
: If any person after being warned by a railway servant
persists on traveling on the roof / steps or footboard of
any carriage he is liable for imprisonment upto three month
and / or with fine up to Rs.500 /-(Sec.156)
5. Smoking : No person in any
compartment of a train shall, if objected to by any other
passenger in that compartment smoke therein. Whom ever
contravenes the above provisions is liable for fine upto Rs.
100/- (Sec.167)
6. Theft of luggage
: In the case of
luggage which is carried by the passenger in his carriage,
the liability for any loss, destruction and damage shall be
with the passenger. However, in case of theft of luggage and
other belongings, robbery or dacoity in running trains, the
forms of lodging report with the police are available with
train conductor, Coach Attendants, Guards and GRP escorts.
After properly filling the form, it may be handed over to
one of the Official mentioned above for Registration report
at the next police station. Passengers are not required to
break their journey for lodging their report with the
police.
7. Railway liability on loss of booked
consignments: Persons booking consignments should
declare the value of such consignment in writing and pay the
prescribed percentage charges on the value exceeding Rs.
100/- Kg in the case of luggage and Rs. 50/- per K.G in the
case of other consignments. If no such a declaration is made
and the additional percentage charges paid then in event of
loss, destruction or damage to the consignment, the amount
of liability of the Railway shall not exceed the amount
calculated at the rate of Rs. 100/- per kg. in the case of
luggage and Rs. 50/- per kg. in the case of other
consignment.
OFFENCES UNDER INDIAN RAILWAY ACT.
(a) Carriage of dangerous/offensive/inflammable
goods.
(b) Man traveling in ladies carriage.
(c) Smoking in Railway Carriage is prohibited.
(d) Drunkenness or nuisance on a Railway.
(e) Unauthorized entry into reserve carriage.
